PRIVACY STATEMENT - Personal Data Protection Policy (Job Applicants)

Dear applicant,

since you decided to apply for a job at PALETEXPRESS, after applying for employment, or after the start of the selection process to fill the vacant job position of your choice, this PRIVACY STATEMENT – EMPLOYMENT APPLICANTS (hereinafter referred to as the "statement") will also apply to you and your personal data. For the purposes of this statement, PALETEXPRESS is considered the operator of your data (hereinafter referred to as the "data operator"). This statement explains how we will use your personal data obtained directly from you or from third parties during the selection process to fill a specific job position.

If you are interested in obtaining more detailed information than is provided in this statement, please contact the person responsible for data protection (see below).

We may update this statement from time to time without notice. Therefore, we ask you to regularly familiarize yourself with its wording. This version of the statement was issued on May 25, 2018.

TYPES OF PERSONAL DATA

When you apply for employment with us, we also obtain the following information from you:

  • Personal contact data - for example your name, address, email address, telephone number;
  • Information from your resume / CV - for example, information about your previous jobs, education, skills, language skills and any other information you choose to include in your CV;
  • Cover Letter - any information you choose to include in your cover letter
  • Eligibility for work - data related to the possible obligation to demonstrate legal ability to perform the job in question;
  • Declaration of integrity - depending on the nature of the job and the country concerned, we may ask you to submit a declaration from the relevant public authority confirming that you have not been legally convicted of any criminal offence, which would be the reason for your exclusion from the selection process of applicants for the given job position, for example, an extract from the criminal record;

In addition, depending on the position you are applying for, we may also receive information from third parties as follows:

  • Internal applications. If you already work at PALETEXPRESS and are applying for an internal position, we may use information from your personal file to supplement the information you provide us in the employment application or that you indicate at a personal interview;
  • Assessment. We may ask you to undergo an assessment of your skills, personality or cognitive ability. Such assessments are typically conducted using third-party software or through a third-party company that shares the results with us. Before carrying out such an assessment, we will provide you with additional information regarding your specific case,
  • References. We may choose to obtain references from people who have worked with you in the past. Generally speaking, we will only contact these individuals if you provide us with their names and contact information. If you are already an employee of PALETEXPRESS, we may ask your manager and/or co-workers for references, even without your knowledge.

PURPOSES OF DATA PROCESSING

The operator will process your data for the following purposes:

  • Recruitment. We process your data to determine whether you are a qualified candidate for the position you are applying for.

PARTES THAT MAY HAVE ACCESS TO YOUR DATA

The operator may share your data with third parties under the following circumstances:

  • For the purpose of obtaining information from third parties (as mentioned above), we will provide them with your name and any other information necessary for them to provide us with relevant information about you;
  • We may share your personal data with other third parties who act on our behalf, for example with suppliers of certain services for our company (contracted recruitment agency, etc.). In such cases, these third parties may process your personal data only for the purposes described above and only in accordance with our instructions;
  • Our employees will have access to personal data. In such case, access will only be granted if necessary for the above purposes and only if the employee is bound by a duty of confidentiality;

LOCATION OF YOUR PERSONAL DATA

Authorized employees of the PALETEXPRESS company based in the Slovak Republic within the EU and EEC will have access to your personal data.

STORAGE OF PERSONAL DATA

We only keep your personal data for a limited time, and they will be deleted when they are no longer needed for the processing purposes stated in this statement. This means that we will keep your data for the duration of the selection process and delete it after we have selected a suitable candidate. If we choose you to fill a job position, we will continue to store your personal data in your personal folder, in accordance with internal regulations (Retention Table).

We can process your personal data for a longer period of time if you have given us consent to process your personal data.

LEGAL BASIS FOR THE PROCESSING OF YOUR DATA

We process your personal data because the processing is necessary for the purposes of the legitimate interest we are pursuing or consent if you have asked us for it. Our legitimate interest in this case is to recruit qualified candidates for the respective job positions.

WHAT ARE MY RIGHTS?

It is important that you understand that it is your personal data that we are processing and that we want you to understand this. Although we do not need your permission to process your personal data, you have many rights in relation to the processing of your personal data.

Your Rights What does it mean?
Right of access You can request information about how we process your personal data, including information about:
  • Why we process your personal data
  • What categories of personal data do we process
  • With whom we share your personal data
  • How long do we keep your personal data, or what are the criteria for determining this period
  • What are your rights
  • Where do we get your personal data from (if we didn't get it from you)
  • If the processing includes automated decision-making (so-called profiling)
  • If your personal data has been transferred to a country outside the EEA, how will we ensure the protection of your personal data.

You can also request a copy of the personal data we process about you.
However, additional copies will be charged.
Right to correct or change It is important that we have correct information about you and we ask that you notify us if any of your personal information is incorrect, e.g. if you have changed your name or if you have moved.
Right to be forgotten or right to erasure If we process your personal data in an unlawful way, for example if we process your personal data for longer than necessary or without reason, you can ask us to delete that data.
Right to restriction of processing From the moment you have requested the correction of your personal data or if you have objected to the processing and until we are able to investigate the problem or confirm the accuracy of your personal data (or change it according to your instructions), you are entitled to limited processing. This means that we (with the exception of personal data retention) may only process your personal data in accordance with your consent if it is necessary in connection with legal claims, to protect someone else's rights, or if there is a significant public interest in the processing.
You can also request that we restrict the processing of your personal data if the processing is unlawful, but you do not want us to delete the personal data.
Right to object to processing If you believe that we do not have the right to process your personal data, you can object to our processing. In such cases, we can only continue processing if we can demonstrate compelling legitimate reasons that outweigh your interests, rights and freedoms. However, we can always process your personal data if it is necessary to determine, exercise or defend legal claims.
Right to data portability You can request that your personal data, which you have provided to us for processing on the basis of consent or to fulfill a contract, be provided in a structured, commonly used and machine-readable format. You also have the right to request the transfer of this information to another operator.
Withdraw consent In most cases, we do not process your personal data based on your consent. However, it may happen that in specific cases we ask for your consent. In cases where we do this, you have the right to withdraw your consent to further use of your personal data.

We will also inform other parties to whom we may have provided your personal data about your request/requests.

In case of suspicion, you have the right to initiate proceedings according to § 100 of Act 18/2018 Coll. on the protection of personal data, via www.dataprotection.gov.sk.
